Whether you're seeking to pursue claims on behalf of a class, defending your corporation against class certification, or navigating the strategic complexities of mass arbitration, our trial-tested attorneys bring sophisticated advocacy and deep understanding of Rule 23 procedures, class certification standards, and aggregate litigation dynamics.
Our Class Action Experience Includes:
-
We've served as lead counsel in nationwide securities fraud cases, securing multi-million dollar settlements for investors harmed by accounting fraud, misleading disclosures, and market manipulation. Our team has recovered over $14 million for class members in recent securities cases and currently represents plaintiffs in multiple pending securities fraud actions.
-
From data breaches and privacy violations to false advertising and deceptive practices, we handle consumer class actions under federal and state consumer protection statutes. We've successfully defended corporations against putative class claims and secured dismissals with prejudice in major consumer cases.
-
Dynamis is at the forefront of crypto-related class action litigation. We're currently prosecuting a landmark RICO case against Binance (the world's largest crypto exchange) on behalf of "pig butchering" fraud victims, filed a class action against Eqonex for securities fraud, and represent consumers in data breach litigation involving crypto hardware wallets.
-
We represent both companies defending against mass arbitration demands and individuals pursuing claims through coordinated arbitration proceedings. Our attorneys understand the strategic and procedural nuances of mass arbitration, including class waiver enforcement and arbitration clause challenges.
-
When corporations face class certification motions, we develop aggressive defense strategies including challenging class certification requirements, defeating commonality and typicality, and when appropriate, securing complete dismissal of claims. We've successfully defended national corporations in consumer and securities class actions in multiple federal districts.
With offices in Boston, New York, and Miami, Dynamis attorneys have handled class actions and mass litigation in jurisdictions throughout the United States, including the Southern District of New York, Northern District of California, Northern District of Illinois, District of Massachusetts, and Southern District of Florida.

Frequently Asked Questions About Class Actions
-
A class action is a lawsuit where one or more plaintiffs (the "class representatives") sue on behalf of a larger group of people (the "class") who have similar claims against the same defendant. Class actions are governed by Federal Rule of Civil Procedure 23 in federal court and similar state court rules. They're used when many people suffer similar harm, making individual lawsuits impractical or inefficient.
-
If a court certifies a class action and you fall within the class definition, you'll typically receive a notice explaining the lawsuit, your rights, and how to participate or opt out. Class notices are sent by mail, email, or published in newspapers depending on the case. You can also search court dockets or class action settlement websites to see if cases apply to you.
-
Under Rule 23, a class must satisfy four requirements: (1) numerosity (too many class members for individual lawsuits to be practical), (2) commonality (common questions of law or fact), (3) typicality (representative's claims are typical of the class), and (4) adequacy (representatives and counsel will fairly protect class interests). The class must also fit within one of three types defined in Rule 23(b), most commonly (b)(3) requiring that common issues predominate.
-
Class actions typically take 2-5 years from filing to resolution, though some complex cases can take longer. The process includes motion to dismiss, class certification briefing and hearings, discovery, summary judgment motions, and potentially trial. Many class actions settle before trial, often during mediation after class certification. Securities fraud class actions under the PSLRA (Private Securities Litigation Reform Act) have specific procedural requirements that can extend timelines.
-
Arbitration clauses with class waivers can prevent class actions if properly drafted and enforceable. However, recent trends show increased use of "mass arbitration" where thousands of consumers file individual arbitration demands simultaneously, creating similar burdens to class actions. Whether arbitration clauses are enforceable depends on state law, federal arbitration act interpretation, and specific contract language. We help both enforce arbitration clauses and challenge them when appropriate.
